WINE CASE - TERMS & CONDITIONS
1 INTERPRETATION
In these conditions the following words have the following meanings: "you" means the person(s), firm or company who orders product(s) from The Wine Case "Confirmation of Order" means an e-mail sent by Wine Case to your e-mail address as notified to The Wine Case, confirming the details of your order for product(s). "Contract" means any contract between Wine Case and you for the sale and purchase of the product(s), incorporating these Conditions, excluding any contract for the delivery by Wine Case to you of the product(s). "Delivery Address" means the address notified to Wine Case for delivery of the product(s) in the section in Wine Case website headed "Checkout". Wine Case (a company registered In England whose registered office is at, 9 Catherington Lane, Horndean, Waterlooville, Hampshire PO8 9HS England. "Products" means any products agreed in a Contract to be supplied to you by The Wine Case. "Working Day" means all days other than Saturdays, Sundays and public holidays.
2 STATUTORY RIGHTS
These conditions do not affect your statutory rights.
3 APPLICATION OF TERMS
3.1 Each order for Products by you from Wine Case is an offer by you to purchase product(s) subject to these Conditions.
3.2 Your order is not binding on Wine Case website until Wine Case accepts your order by sending a Confirmation of Order to you by e-mail or (if earlier) delivers your order to you.
3.3 You are responsible for ensuring that the terms of your order are complete and accurate.
4 DESCRIPTION
The description of the product(s) shall be as set out on Wine Case Website. Where any products are unavailable Wine Case reserves the right to supply substitute products of an equivalent quality and price to those displayed on Wine Case website.
5 DELIVERY
5.1 Wine Case shall deliver the product(s) to the delivery address by give details of delivery.
5.2 Wine Case will not be liable for any loss, costs, damages, charges or expenses caused by any delay in the delivery of the product(s).
5.3 All carrier deliveries must be signed and checked at the time of delivery. Do not sign for a delivery if the item has been damaged. By signing you are accepting the delivered order are not damaged and accept responsible for the goods.
5.4 If product(s) are lost before delivery Wine Case liability shall be limited to replacing the product(s) within a reasonable time or issuing a refund. You must however notify Wine Case if product(s) you have ordered have not been received within 30 days of your receipt of the confirmation of order.
6 RIGHT TO RETURN THE PRODUCTS
6.1 You may cancel the entire contract for any reason during the five day period starting on the day you or the person to whom you have requested that the product(s) be sent receives the products. In these circumstances you can obtain a refund from Wine Case equal to the amount of the price payable under the contract less admin card fee's. You may not cancel part of a contract.
6.2 If you exercise the right to cancel the contract set out in Clause 6.1.
6.2.1 you are entitled to a refund from Wine Case of all amounts that you have paid under the contract but less an delivery and admin card costs which have occurred within 30 days of the receipt by Wine Case of the notice of cancellation;
6.2.2 you must return the product(s) to Wine Case at the address notified to you in the confirmation of order by carrier within three days of giving notice of cancellation to Wine Case. You are required to take reasonable care to ensure that the parcel containing the product(s) is received by Wine Case. You must pay the cost of returning the product(s) to the Wine Case return address.
7 RISK
Risk of damage to or loss of the product(s) shall pass to you at the time of delivery to the person to whom you requested that the product(s) be delivered or, if the person to whom you requested that the product(s) be delivered wrongfully fail to take delivery of the product(s) when they are delivered the time when Wine Case attempted to deliver the product(s).
8 PRICE
8.1 The price for the product(s) displayed on the Wine Case website shall be the price set out thereon; www.winecase.net at the time when you place your order. If the product(s) are to be delivered to an address in the United Kingdom and the total value of your order. If the product(s) are to be delivered to an address other than UK mainland you are also required to pay an extra delivery charge of an amount agreed between you and Wine Case and set out in the confirmation of order.
8.2 For the purchase of Made to Measure Wine Racks via the order form and instructions downloaded from Wine Case website or auto quote system on the website and other, there is a delivery charge regardless of the size of order; this charge applies to UK mainland and does not cover either, Scotland or anywhere offshore.
8.3 If due to an error the price shown on Wine Case website is wrong, we will inform you of the current price and give you the opportunity to cancel your order prior to delivery of the product(s).
9 PAYMENT
9.1 Payment of the price for the product(s) is due with your order and Wine Case shall not be obliged to deliver any product(s) until the full price has been paid. Where payment is made by cheque, payment shall be deemed to be made when Wine Case receives cleared funds for the payment.
10 QUALITY
10.1 Wine Case warrants that upon delivery the product(s) will conform to the description on Wine Case website.
10.2 If any of the product(s) do not conform with any of the warranty in clause 10.1 ("Non conforming product(s)") then if you return the non conforming product(s) Wine Case will replace the non conforming product(s) or refund the price excluding any amount charged for delivery that you have paid for them.
10.3 Nothing in this clause 10 shall affect your statutory rights.
11 DATA PROTECTION
Wine Case will process all personal data that it collects about you in accordance with the provisions of its Privacy Policy in force from time to time.
12 THIRD PARTY RIGHTS
12.1 A person who is not a party to the contract has no right under the contracts (Rights of Third Parties Act) 1999 to enforce any term of the contract but this does not effect any right or remedy of a third party which exists or is available apart from that Act.
12.2 A person who is not a party to the contract for delivery of the product(s) has no right under the contracts (Rights of Third Parties Act) 1999 to enforce a term of the contract for the delivery of the product(s) but this does not effect any right or remedy of a third party which exists or is available apart from that Act.
13 LAW
The contract between you and Wine Case shall be governed by English law and you submit to the non-exclusive jurisdiction of the English courts.
